1. Introduction
Welcome to GentleMarshShade ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at gentlemarshshade.sbs (the "Service") operated by GentleMarshShade.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
2. Service Overview
GentleMarshShade offers top-tier yacht charter services, which include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability is subject to change based on weather conditions. We have the discretion to alter or cease services at will.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, the following criteria must be met:
- Attaining at least 18 years old
- Submitting true and comprehensive details
- Making a payment of the preliminary deposit as noted in the booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking is considered confirmed only after the payment has been made and you receive our written confirmation. We retain the right to decline service at our own judgment.
3.3 Availability
Charter services are contingent upon the availability of vessels and favorable weather conditions. We will endeavor to meet your preferred scheduling whenever possible.
4. Payment Terms
4.1 Pricing
All service fees are denominated in € and taxes are included, unless otherwise specified. Fees are subject to modification without prior notice.
4.2 Payment Schedule
- Deposit: A payment of 50% of the entire cost of the charter is required at the time of booking
- Balance: Payable 48 hours prior to the departure of the charter
- Additional expenses: Settled following the completion of the charter
4.3 Payment Methods
We accept payment through major credit cards, bank transfers, and certified checks. All payments are processed using secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancellation is done more than 72 hours prior to departure: A complete refund minus processing fees
- Between 24 to 72 hours prior to departure: Half of the amount will be refunded
- Less than 24 hours ahead of departure: No refund will be granted
5.2 Weather Cancellations
In case our captain evaluates the weather as unsafe, we will propose to:
- Rebook your trip to the next available date with no added charges
- Offer a full refund if rebooking cannot be arranged
5.3 Mechanical Issues
If mechanical disruptions occur with the designated vessel, we will attempt to provide a suitable alternative. If that is not possible, a full reimbursement will be offered.
6. Safety and Conduct
6.1 Safety Requirements
All guests must adhere to the following safety measures:
- Obey all instructions given by the crew
- Make use of the supplied safety gear when necessary
- Report any health conditions that could affect their personal safety
- Stay within the designated areas aboard the vessel
6.2 Prohibited Items
The subsequent items are prohibited on the yacht:
- Glass containers
- Illegal substances
- Weapons or firearms
- Pets, unless prior approval has been obtained
6.3 Conduct
Passengers must behave respectfully. We reserve the authority to end a charter before its scheduled completion without any refund if the actions of any passenger compromise safety or disrupt the experience of others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the amount paid for your charter. We are not accountable for:
- Injuries caused by passengers' negligence
- The loss or damage of personal items
- Indirect or punitive damages
- Delays resulting from weather or unforeseen circumstances that are out of our control
7.2 Insurance Coverage
Comprehensive marine insurance is maintained to cover our vessels and operations. Guests are responsible for securing their personal travel and belongings insurance.
7.3 Assumption of Risk
Engaging in our charter services implies acknowledgment of the inherent risks involved in marine activities and an agreement to accept personal responsibility for your safety.
8. Modifications and Itinerary Changes
Modifications to itineraries or schedules may occur due to factors such as weather, safety, or operational demands. We will strive to provide a comparable alternative when such changes are necessary.
9. Force Majeure
Events beyond our control that may influence delays, cancellations, or changes to services include, but aren't limited to:
- Extreme weather conditions
- Natural catastrophes
- Regulations set forth by authorities
- Port shutdowns
- Unforeseen mechanical breakdowns
10. Privacy and Data Protection
Your private data is managed in accordance with our Privacy Policy. Usage of our service is an implicit consent to the data collection and use as laid out in the policy.
11. Intellectual Property
Copyright and trademark laws protect all materials shown on our website, such as texts, images, and logos. Without our written consent, these materials must not be replicated or distributed.
12. Governing Law
The laws of France shall govern these Terms. Any disputes will be adjudicated in the courts located in Nice, France.
13. Changes to Terms
We maintain the right to modify these Terms at our discretion. Such changes will be communicated on our website, along with the updated date of revision. Continued patronage of our services implies consent to the amended Terms.
